PRIVACY POLICY

TL;DR VERSION

  • We will never sell any of your personally identifying information or any content you upload ("Personal Data") to any third parties.
  • We may share your Personal Data with third parties we hire to perform specific tasks for us, but only if they agree to keep it confidential. For example we might share your email address with a company that sends out emails on our behalf.
  • We may share emotional data and demographic information with third parties in a way that does not allow you to be identified. For example we may allow advertisers to display ads to people who feel a certain way.

COMPLETE PRIVACY POLICY

Welcome to Emotely ("Emotely", "we", or "our"). We respect your privacy and want to protect your personal information. This Privacy Policy explains how we collect, use and (under certain conditions) disclose your personal information. This Privacy Policy also explains the steps we have taken to secure your personal information. By using our mobile applications, websites, emails, text messages, blogs and social media accounts (collectively, "Services"), you accept the practices described in this Privacy Policy and the Terms of Use of our Services.

INFORMATION WE COLLECT

We collect information from you in several different ways in the Services:

(a) Information You Provide Us

Account Information: When you create an account you provide us your username, email, password and/or social media accounts used to login (e.g. Facebook or Twitter account). Only your username will be visible to other users of the Services.

Profile Information. When you create a user profile you may provide to us certain personal information, including but not limited to your gender, website and photographs. Your profile information will be visible to other users of the Service. If you mark your profile as private, only users you allow will be able to see your profile information.

User Generated Content. When you use our Services, you may share user generated content with us, for example sending an emote which contains a photograph, your personal emotions, and location. This content may be visible to other users on the service (you can set privacy levels for each emote you create).

Friends. If you use our Services to find your friends or send communications to your friends, you will be sharing your friend’s contact information with us.

(b) Cookies and Other Technology. When you use the Services we may use cookies or similar technologies like web beacons or local storage to recognize you and your access privileges, and track your usage of the Services. OUR SERVICES’ COOKIES DO NOT AND CANNOT INFILTRATE A USER'S HARD DRIVE TO GATHER A USER'S CONFIDENTIAL INFORMATION. Our cookies are not "spyware". We may use third-party advertising companies to help us tailor content to users or to serve ads on our behalf. These companies may employ cookies or similar technologies to measure advertising effectiveness (such as which pages are visited or what products are purchased and in what amount). Any information that these third parties collect via cookies and web beacons is not linked to any personal information collected by us.

(c) Log Files. As is true of most online services, the Services automatically recognizes the Internet IP address and device information from which you access the Services. We log this information for system administration, internal marketing, and system troubleshooting purposes.

(d) Analytics Information. We use third-party tools to track your usage of our Services to help us analyze usage trends and improve our products. These tools collect information about how you use our Services, including the pages you visit and actions you take in our Services.

HOW WE USE YOUR INFORMATION

Our goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:

  • help make the Services easier for you to use by not having to enter information more than once.
  • help us create content on the Services that is most relevant to you, which could include advertisements.
  • send you account related emails or notifications, for example resetting your password (you cannot opt out of account related communications).
  • send you service related emails or notifications, for example when another user follows you (you can always opt out of service related communications).
  • send you marketing emails or notifications about our Services or other services you may be interested in (you can always opt out of marketing communications).
  • Improve, analyze and test our Services.

INFORMATION SHARING

We do not sell, rent, trade or license your personal identifying information (e.g. email address, name, address, phone number, etc).

As do most online service providers, we sometimes use others to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, in order to deliver email to you, we might share some information including your name and email address with a third party that specialize in delivering email. Or as another example, so that we can obtain feedback and improve the quality of our service we may share your information with a third party to perform customer satisfaction surveys on our behalf. We will only share this data with third parties who have agreed to keep your information confidential.

It's possible that we might merge with or be acquired by another company or that we might dispose of some or all of our assets. If that happens, your personal information may be disclosed to another company, but that disclosure will be subject to the Privacy Policy in effect.

We may be required to disclose certain information in response to requests from law-enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal information where disclosure is necessary to protect our legal rights, enforce our Terms of Use or other agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use our Services for illegal reasons or to commit fraud.

We may share your non-personally identifying information (such as your emotional data or demographic data) with third parties such as advertising partners. This information does not directly personally identify you or any user.

ACCOUNT DELETION / RETENTION

You may delete your account at any time. If you do so, your photos, emotes and personally identifying information (e.g. email address, social media accounts, etc) will be permanently deleted from our records, although you may continue to exist in our file backups as necessary to comply with our legal, tax and accounting obligations, resolve disputes, and enforce our agreements. Your interactions with other users (e.g. comments, messages) will remain in their histories and in our records. Other users you interacted with will only see your username and a blank profile with no personal information.

CHILDREN’S PRIVACY

We respect children's privacy. We do not knowingly or intentionally collect personal information from children under age 13. If you are under the age of 13, please do not submit any personal information to us. If you believe that we might have any personal information from a child under 13, please contact us at privacy@emotely.com.

DATA SECURITY

The Services incorporate physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information, including Secure Sockets Layer ("SSL") for all communication between our Services and our databases. We use SSL encryption to protect your personal information online, and we also take several steps to protect your personal information in our facilities. Access to your personal information is restricted. Only employees who need access to your personal information to perform a specific job are granted access to your personal information. Finally, we rely on third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are adequate. For example, when you use our mobile application, you access servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall. While we use industry-standard precautions to safeguard your personal information, we cannot and do not guarantee complete security. 100% complete security does not presently exist anywhere online or offline.

OPT OUT

On your request, we will stop sending service related or marketing emails to your email address. You can make these requests from within the Services or by clicking unsubscribe from any marketing emails we send you. You cannot opt out of certain account related communications (for example password reset or important legal notifications).

OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION

As you might expect, the majority of information that we collect is obtained through our Services, and this Privacy Policy applies only to that online collection of personal information. We may also collect information offline, where we also try to protect the privacy of your personal information. One example involves someone calling us to ask questions. When someone calls, we will ask only for the personal information we need in order to answer the question. When we need to store information we will enter it into our database. Another example involves faxes. If you fax something to us, we will act upon the fax and then either store or shred the fax, depending on whether there is any need to retain the information. There are other ways we could learn of personal information offline (for example, we suppose someone could send us a letter including some return address information), and this Privacy Policy doesn't discuss or try to predict all of those methods or uses. We will try to treat offline collection, uses, and disclosures consistently with our relevant online practices.

REFERRALS

If you choose to use our referral service to tell a friend about our Services, we will ask you for certain information about your friend in order to contact them like name, phone number (in the case of SMS referrals), email address (in the case of email referrals), Facebook username, or Twitter username. We will automatically send your friend a one-time message inviting him or her to visit the site, and a limited number of reminders. Emotely stores this information for the sole purpose of sending these invitations and tracking the success of our referral program. We will never sell or share this information. Your friend may contact us via email at privacy@emotely.com to request that we remove this information from our database.

SOCIAL MEDIA WIDGETS

Our Services may include Social Media Features, such as the Facebook Share button. These Features may collect your IP address, which page you are visiting on our website, and may set a cookie to enable the Feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

SINGLE SIGN-ON

You can log in to our site using sign-in services such as Facebook Connect. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on the Services to your profile page to share with others within your network.

LINKS

We are not responsible for the content or privacy practices on any third party services to which our Services link or that links to our Services.

CALIFORNIA PRIVACY RIGHTS

California Law permits our customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to us at privacy@emotely.com.

UPDATES TO THIS POLICY

If we change or update this Privacy Policy, we will post changes and updates on our Services so that you will always be aware of what information we collect, use and disclose. We encourage you to review this Privacy Policy from time to time so you will know if the Privacy Policy has been changed or updated. If we make material changes to this Privacy Policy, we may notify you here, by email, or by means of a notice in our Services prior to the changes taking effect.
